About the Fraudsters
Involved in Promoting the Morrisseau “fakes” HOAX
SINCE THE JUDGMENT OF THE
Hon. Madam Justice Mary Anne Sanderson in Superior Court, on Dec. 17, 2013, totally discredited them & their claims.
On Aug. 5, 2015
Deputy Judge CW Kilian, Toronto Superior Court (SCC Div)
“Jim White v Ritchie Sinclair,”
For Libel & Defamation
Found Ritchie Sinclair of Toronto, ON
Longtime business associate of Toronto’s Kinsman Robinson Galleries,
and Toronto “entertainment” lawyer Jonathan Jerome Sommer
Guilty of Libel & Defamation in All Respects
(Defamation & Slander of Title)
And fined him $25,000 plus costs of $3,750.
(The maximum allowed in Small Claims Court)
Judge Kilian said, had it been in his jurisdictional power to do so
he would have also fined Sinclair another $10,000 for Punitive Damages.
“For his reckless false allegations
disseminated on a world-wide media.”
Clearly Judge Kilian, who was not aware of the CTV fraud, was more than a little outraged by the other evidence and testimony he saw displayed before him, alleging – without the slightest proof or substantiation – that White was selling forgeries, including – in one case – a painting White had never, ever even owned or handled.
Since October 2008, Ritchie Sinclair has been famously involved as the “Enforcer” for Toronto’s Kinsman Robinson Galleries (since 2008), and as a close associate of Toronto lawyer Jonathan Jerome Sommer (since 2009), working in tandem with them to promote the HOAX of “thousands of Morrisseau fakes by umpteen forgers” that has been totally discredited by forensic experts and multiple judges in multiple courts.
Deputy Judge CW Kilian is now the seventh (7th) judge to have dismissed, rejected, or scorched Ritchie Sinclair as not a believable or trustworthy witness, and/or found him to make false and/or unsubstantiated claims about events, about art, himself, his credentials, etc., and especially about his self-proclaimed experience or expertise on the art of Norval Morrisseau: The Hon Justice Thomas A Lederer 2008, Judge MD Godfrey 2011, Deputy Judge Warren McCrea 2012, Deputy Judge Paul J Martial 2013, The Hon Justice Alphonse T Lacavera 2013, The Hon Madam Justice Mary Anne Sanderson 2013, Deputy Judge CW Kilian 2015.
Sinclair’s malicious and fraudulent attacks on reputable Canadian business people and their genuine Morrisseau paintings, published by a witless, gullible, and negligent mainstream media, have resulted in lawsuits initiated by different parties against Sinclair personally but also against: Postmedia (Toronto), CTV (Toronto), SAW Gallery (Ottawa).
Sinclair’s last previous outing in a court was as a witness for Toronto lawyer Jonathan Jerome Sommer in Hatfield v Artworld, where he was hugely scorched and dismissed by Deputy Judge Paul J Martial as not credible on any level.
Ritchie Sinclair’s Perjury – Sinclair was also cited for perjury before Madam Justice Mary Anne Sanderson by winning Defence counsel Brian Shiller, related to the damning “Kevin Cott Incident.”
In the summer of 2008, Ritchie Sinclair, hoping to win a showcase for his art at Toronto’s Liss Gallery, had advised one of the gallery’s clients – a passionate art collector Kevin Cott – to buy a specific “wonderful Morrisseau.” So Cott bought “Season of Rut for Moose 1977” for $27,000.
A few months later, and tellingly, after failing to win a showcase for his Faux-nishinaabe art at the Liss Gallery, Sinclair posted the painting on his website as a “forgery,” without telling Cott.
Four years later, in 2012, I heard and saw Cott testify in court, that he only learned about Sinclair’s duplicity – that he called his painting a fake – a few weeks before he was asked to testify against Sinclair in Hatfield v Artworld.
Sinclair claimed he never told Cott the painting was genuine, that Cott was lying.
The courts, and Defense counsel Brian Shiller, saw it differently, as Sinclair lying and taking revenge on a gallery that refused to represent his “Faux-nishinaabe” art.
Note: It is wise to remember that only a few months after telling Cott that “Moose in Rut” was a wonderful and genuine Morrisseau, that Sinclair abruptly changed his opinion, from praising countless Morrisseau BDP paintings as “masterpieces” and “wonderful” on multiple web sites, to calling exactly the same paintings as forgeries and fakes. Within only a few days he posted 1,000 low res images of paintings he had never seen or handled in person, as fakes, on Oct. 13, 2008, on his malicious and defamatory web site.
Hey! What the hell has suddenly changed?
Simple, Dear Diary: Ritchie Sinclair had suddenly decided – after his “Faux-nishinaabe” art show at the Scollard Gallery had disastrously failed, just before the bankruptcy of the gallery – to accept “My Mentor,” Donald Robinson’s offer to become an “enforcer” for Toronto’s Kinsman Robinson Galleries, and to subscribe to and to promote KRG’s fraudulent claim that there are “thousands of fakes by umpteen forgers” out there…
Their accomplishments: destroying the valuation of genuine Morrisseau paintings to the tune – by one estimate – of $100 million, thus committing the greatest act of cultural genocide against Aboriginal peoples in Canadian history. This slides to a distant second place, the Canadian Government’s own ignominious, and malicious theft, and dispersion for pecuniary gain, of some 600 Kwakwaka’wakw religious and ceremonial artifacts taken from the people of Alert Bay, and environs, BC, in 1921.
In 2015 Sinclair is still at it though multiple court actions have totally and without caveat or qualification, discredited him, his KRG “Mentor,” and their allegations about so-called Morrisseau “fakes.”
Deputy Judge CW Kilian’s judgment is just one of the most total discrediting of Ritchie Sinclair to date.
As well as being a witness for Sommer, I have observed Sinclair, on multiple occasions (2011-2013), in multiple courts (Small Claims & Divisional Court) vigorously acting as Sommer’s legal advisor (Sinclair does have some high school), even though Sinclair was neither a Defendant or a Plaintiff in those actions.
Sinclair along with his roommate, Garth Cole, have worked separately or in tandem, as Sommer’s legal assistants in document serving (2013-2014).
Sinclair has also been hugely involved in using his website and media outings to openly and specifically promote Jonathan Sommer’s Morrisseau “fakes” related legal cases, including scorching Judge Martial after he hugely dismissed Sommer’s Hatfield v Artworld case, accusing him of making some 35 judicial mistakes. Where would Sinclair, a community college dropout, possibly get detailed legal information like that?
Both Sommer and Sinclair often appear in the same media articles promoting the same discredited allegations about “fakes,” when neither they, nor anyone else, has ever proven a single “fake” to exist, and all the paintings the duo has targeted were proven both by judges and forensic scientists to be 100% genuine.
I do not know of a witness, in Canadian legal history who has been more discredited than Ritchie Sinclair, unless it is Donald Robinson whom Sinclair calls “My Mentor.”
“Morrisseau” Cases Promoted by Kinsman Robinson Galleries “Enforcer” Ritchie Sinclair, totally lost by Jonathan Sommer & decisively won by Brian Shiller as maliciously, falsely, and fraudulently alleged
– Hatfield v Artworld – hugely dismissed by Deputy Judge Paul J Martial 2013
– Hatfield v Artworld Appeal – hugely dismissed by Justice Mary Anne Sanderson 2013
– McDermott v Maslak McLeod – abruptly dropped by singer John McDermott 2013
For more information about the lawyer who chooses to use and work with these multiply-discredited witnesses, over and over again, even though the evidence is overwhelming and hugely documented that they are involved in promoting and perpetuating the “greatest fraud in Canadian art history,” resulting in the biggest act of cultural genocide against Aboriginal peoples in Canadian history.
